Daily hearings begin in Greater Noida land cases

The day-to-day hearing of land acquisition cases in Noida and Greater Noida began at the Allahabad high court on Monday. A full bench comprising justices Ashok Bhushan, S U Khan and V K Shukla permitted the counsels of all parties to argue the writ petitions filed pertaining to land acquisitions in Patwari village, Noida Extension.

The petitioners submitted through their counsel that while their lands were acquired for industrial development at giveaway prices, the government “changed the land use” and handed them over to private builders at very high prices. The farmers also said that they were deprived of a hearing before their lands were acquired.

The counsel appearing for the state government and the Greater Noida Authority countered this and reasoned that at this stage, when three years have elapsed since the date of notification for acquisitions, the farmers’ petitions cannot be entertained. There has been no change of land use and “substantial development” has already taken place in the area with the construction of roads and drainage system at a cost of Rs 30 crore, the counsel argued. Also, a “third party interest” has emerged with a number of builders and flat buyers investing in the housing projects, the government told court.

The government further submitted that the recent apex court judgment in the Shahberi village case cannot be applied in the case of Patwari village since in the former case, land use was changed and there was no development work there. Also, 80% farmers in Patwari have already taken the compensation for their acquired lands and have been allotted 200 individual plots in Sector-II.

The hearing is likely to continue on Tuesday.

Earlier in August, the Allahabad high court had asked the UP government, Noida and Greater Noida authorities, builders and others to file counter-affidavits on hundreds of petitions filed by Gautam Budh Nagar farmers, challenging acquisition of more than 3,000 hectares of land for development of Greater Noida and Noida Extension. A full bench of the court had decided to hear the cases on a day-to-day basis from September 12.
