Attorney Generals Cry Out Against Continuation of Foreclosures

Attorney Generals in nearly 40 states are poised to cry out against continuation of foreclosures. A joint investigation is in the offing regarding defective foreclosures according to an inside report. The lead to the Attorney Generals of the state has been given by Iowa’s Tom Miller. The Attorney General of New Mexico Gary King said that his office would participate in this multi-state attack.

The legal experts of the lenders are expecting widening of the investigation said Patrick McManemin of Patton Boggs LLP based in Washington. His firm acts on behalf of banks, servicers and other financial entities.

The largest lender in the country Bank of America extended moratoriums on foreclosures in all 50 states.

McManemin said, “We are aware of or involved in a large number of investigations that lead us to believe there are in the neighborhood of 40 state attorneys general who have initiated investigations or expressed an interest”. He was speaking over a telephonic interview.

The officials of a minimum of seven states have already said they are proceeding with investigations about faked documents and forged signatures to find out if the information given by the employees is true. Miller said that he has joined up with officials of the state, bank regulators and the Justice Department to kick off a coordinated action. The Attorney Generals of Connecticut and Ohio have already spoken out against these alleged malpractices.

On November 16th a meeting will be held of the Senate Banking Committee to probe into the operations of mortgage firms and their servicers as regards foreclosures.

The chairperson of the panel Christopher Dodd (Connecticut/Democrat) assured the families of America that they should not nurse worries about forfeiting their homes because of slipshod bureaucratic mismanagement. He added that regulators at all levels – federal, state as well as local have the responsibility to see that the law is upheld and consumers protected from injustice.

Three mega banks, Ally Financial, JPMorgan Chase and Bank of America have already frozen their foreclosure operations in 23 states. In these states the foreclosures have to go through the courts.

Harry Reid the majority leader of the Senate (Democrat/Nevada) urged on all other banks and mortgage entities to follow the lead given by Bank of America and “review their practices to ensure that they are not unfairly targeting homeowners in Nevada and across the nation”.
